The trial is held before Trial Chamber V(a) composed of Judge Chile Eboe-Osuji (presiding), Judge Olga Herrera Carbuccia and Judge Robert Fremr. The trial's opening started with the reading of the charges against William Samoei Ruto and Joshua Arap Sang. Upon receiving confirmation from each leading Defence Counsel, Presiding Judge Chile Eboe-Osuji was satisfied that the accused understood the nature of the charges. Both accused pleaded not guilty to the charges. The Court's Prosecutor Fatou Bensouda and trial lawyer Anton Steynberg took the floor for opening statements, followed by the Legal Representatives of Victims Wilfred Nderitu, and by Mr Ruto's Defence Counsel Karim Khan. The hearings will resume tomorrow with the opening statement of Mr Sang's Defence Counsel Joseph Kipchumba Kigen-Katwa and will continue on Tuesday, 17 September until 4 October and subsequently from 14 October to 1 November 2013. The hearings in this trial are not scheduled to overlap with those in the second trial related to investigations in Kenya, The Prosecutor v. Uhuru Muigai Kenyatta, which is to open on 12 November 2013. Instead, the two trials will be scheduled to alternate in periods of four weeks minimum. Detailed hearing schedules in the cases will be issued by ICC judges in due course. The trial in the Ruto and Sang case is expected to take several months. During the first part, the Office of the Prosecutor will be presenting the evidence at the Prosecution's disposal, submitting to the attention of the judges a large number of documents which it has compiled in the case, as well as video footage. The Prosecution will also call witnesses to testify. When the Prosecution has finished examining each witness, the Defence Counsel is given the opportunity to cross-examine the witness. Once the Prosecution has presented all its evidence, which will take a few months, it is the turn of the accused, with the assistance of their Counsel, to present their defence. The Defence will call a number of witnesses to support their case. These will be examined by the Defence and cross-examined by the Prosecution. 327 persons are participating as victims in the case and are represented by their Legal Representative, Wilfred Nderitu, who will present their views and concerns in the Courtroom. Judges will ensure that the trial is fair and expeditious and is conducted with full respect for the rights of the defence, the equality of arms and the principle of adversarial debate, having further due regard for the protection of victims and witnesses. At the end of the hearings, the judges of Trial Chamber V(a) will give their decision within a reasonable period of time. This decision will be pronounced in public: it will either acquit or condemn each of the accused. The various parties to the trial will, if need be, be able to appeal the decision before the ICC's Appeals Chamber.

Some lawyers from the African continent stormed the United States Embassy on Friday in protest of the country’s refusal to recognize the Indigenous People of Biafra, IPOB, as a terror squad. The development is coming barely 24 hours after some protesters shutdown the US Embassy over same complains. Recall that the United States Government had said it does not categorize the Indigenous People of Biafra (IPOB) as a terrorist organisation under US law. A letter signed by Barrister John Oboh, the country’s representative of the League of African Democratic Lawyers and addressed to the Ambassador of the United States of America to Nigeria, the protesting lawyers faulted the US for taking sides with the agitators. Oboh said a US endorsement of IPOB would spark a wave of separatist agitations across the continent, saying that it was pertinent that the events in Nigeria were assessed on the strength of their continental impact and global ramifications. According to the group, “Kabylie in Algeria; Lunda-Tchokwe and Cabinda in Angola; Bakassi and Ambazonia in Cameroon; Logone in Central African Republic; Anjouan in Comoros; State of South Congo in Republic of the Congo; Bas-Congo, Katanga and United Republic of Kivu in Democratic Republic of Congo, Bioko Island in Equitorial Guinea; Islamic State of Afaria, Gambela, Ogaden, Oromia and Sidama in Ethiopia; Mombassa Republic and Western Republic of Somalia in Kenya; Cyrenaica and Touboulandin Libya; Azawad in Mali; Rif and Western Sahara in Morocco; Free State of Caprivi in Namibia, Agadez and Tenere Republic in Niger; Batwaland in Rwanda; Somaliland in Somalai; Western Cape and Volkstaat in South Africa; Nuerland in recently breakaway South Sudan; Darfur in Sudan; Zanzibar in Tanzania; Kingdom of Buganda and Yiira Republic in Uganda; Barotseland in Zambia; and Matabeleland in Zimbabwe are a few of the separatist, autonomic and secessionist groups that will grow violent like IPoB in the hope that they will get similar endorsement from the United States.” The letter further added that the concern is that not many of these countries have the resources or the framework to contain such agitation with the efficiency with which Nigeria did without creating grave humanitarian situations that require global intervention. The letter added, “Considering that the recognition of IPoB will simultaneously reignite all these separatist movements while encouraging even the politically oriented ones among them to turn violent, the various international organizations are not equipped to deal with continent-wide pockets of violent insurrections that will result. The remaining stable countries of the world must then be prepared to host the portion of Africa’s 1.2 billion people that will pour over their borders.” Speaking on the activities of IPOB, the group said, there is nothing indigenous about IPoB or the defunct Biafra they are striving to revive. “Our research clearly show that on the contrary, persons from the modern day are of what was the defunct Biafra are actually displacing Nigeria’s other ethnic nationalities from their ancestral land ,erode their culture and impose themselves on the commercial interests of their host communities. “Even where IPoB successfully claims the status of “Indigenous Peoples”, we urge the United States not to lose sight of Article 46 (1) of the United Nations Declaration on the Rights of Indigenous Peoples, which clearly states that “Nothing in this Declaration may be interpreted as implying for any State, people, group or person any right to engage in any activity or to perform any act contrary to the Charter of the United Nations or construed as authorizing or encouraging any action which would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States.” The group further alleged that its consultations has revealed that IPoB’s leader, Nnamdi Kanu included the term “Indigenous People” in his group’s name solely to mislead people of his ethnic stock into believing that the United Nations Declaration on the Rights of Indigenous Peoples refers to them and absolves them of any crime committed in pursuit of reviving the defunct Biafra. “The United States’ endorsement of IPoB flies in the face of the global efforts to rid the world of terrorism. The dangers posed to the world by this magnified by the many persons that have identified as IPoB members all over the world. Once they are done gaining ground in Nigeria, all they need to do is to activate their countless sleeper cells across the world.”

France's transport minister, Dominique Bussereau, was quoted as saying on Thursday in the Le Figaro daily that "worrying anomalies" in the crashed Airbus A310 jet included broken seats for crew and passengers, out-of-date operation manuals, insufficient pressure on emergency exit doors and unrestrained equipment in the baggage hold. French aviation authorities flagged the problems with the plane during a 2007 inspection. Yemenia's lawyer in France, however, said it was too early to say that the plane's condition was the cause of the accident. A severely bruised young girl believed to be the only survivor of an Indian Ocean plane crash flew back on Thursday to Paris. She had spent over 13 hours in the water clinging to wreckage before she was rescued. The other 152 people on the plane, including her mother and others from France's large Comoran community, are presumed dead. The passengers were flying the last leg of a journey from Paris and Marseille to Comoros, with a stop in Yemen to change planes. Most of the passengers were from Comoros. This video shows the outcomes of the International Plant Protection Convention (IPPC) Phytosanitary Capacity Evaluation project funded by The Standards and Trade Development Facility (STDF 401 project). More: https://www.ippc.int/en/pce/ To protect plants from pests, it is essential to have strong national phytosanitary systems in place. National plant protection organizations are responsible for implementing the International Plant Protection Convention or IPPC and its Standards. The IPPC provides the framework for concrete technical assistance to countries using the IPPC Phytosanitary Capacity Evaluation tool, also known as the PCE. So what is the PCE? The Phytosanitary capacity Evaluation or PCE is a management tool designed to help a country identify its strengths and gaps in its existing and planned phytosanitary systems. The strategic plans developed through PCEs provide the basis for dialogue with donors, improving the likelihood of accessing funding and strengthening phytosanitary systems. The PCE tool is implemented through consensus, it is confidential. To date, 121 countries in 7 regions have benefitted from the PCE. Reviews of the PCE show their positive impacts. For example, in April 2017, Comoros applied the PCE tool, which resulted in the Parliament adopting new phytosanitary legislation. Combined with a new phytosanitary capacity development strategy, Comoros is improving its market access and food security, protecting its agricultural production and the environment. They are also attracting donors in the process. Comoros relies on imports, which are now sources for the introduction of plant diseases. Bananas, coconut palms, cassava and cash crops were attacked many times over the past decade. This poses a threat to food security and to the country's economy. With the support of its partners, including the STDF, the United Nations Development Programme and the International Plant Protection Convention, our country has updated its sanitary and phytosanitary legislation. It was important for us to support this law, which we unanimously adopted to ensure the well-being of our people. This PCE project was financed by the Standard and Trade Development Facility or STDF. The PCE builds the capacities of National Plant Protection Organizations to implement IPPC standards. It aligns with the STDF objective to increase countries’ abilities to trade safely. The STDF continues to actively support the PCE tool. Since 2012 it has funded a project to train PCE facilitators and lawyers, which helped countries to strengthen their phytosanitary systems. The PCE project, known as STDF 401, trained national experts to conduct PCE in countries. 40 PCE facilitators and more than 20 lawyers were trained as a result of this project. The intensive training entailed a better understanding of the IPPC and its standards, logical framework analysis and results-based management tools. In addition, the project resulted in the development of training materials. Chiluba Mwape was one of the PCE facilitators. What did he gain from the training? First, let me point out it was so helpful to conduct the training first it was group management and presentation skills. These aspects were effectively applied in order to ensure that the participants of the training were all actively engaged and understood what they were doing, and besides that the knowledge that we gained with regards to understanding of the IPPC as well as the PCE process enabled me to deliver the presentations as required. PCE facilitators are now able to share their expertise in any country, and to support the noble mission of protecting plants from pests and making the world a better place.
